TERMS AND CONDITIONS

Please read these Terms and Conditions carefully prior to accessing and using angangroastery.com (“the Website”) or Ang Ang’s Roastery mobile application (“the App”) operated by Ang Ang Roastery (HQ) Sdn. Bhd. (“we”, “our”, “us”). You agree to be bound by these Terms and Conditions including additional terms and conditions and policies and/or available by hyperlink.

We reserve the right to update, change or replace any part of these Terms and Conditions by posting to the Website or the App. Your continued use of or access to the Website or the App following the posting of changes constitutes of those changes.

1. ELIGIBILITY, REGISTRATION AND ACCOUNT 

The Website or the App are not targeted towards, nor intended for use by, anyone under the age of 18. If you are under the age of 18, you may only access or use the Website or the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. If you are a parent or legal guardian of a user under the age of 18, you agree to be fully responsible for the acts or omissions of such user in connection with the Website or the App.

To fully enjoy and utilise the perks and benefits of the App, you are required to create an account. In connection with your account, you agree to (1) create only one account with phone number, (2) provide true, accurate, current and complete information about yourself at registration and (3) maintain and promptly update your account information. You are entirely responsible for maintaining the confidentiality of your account and all of activities that occur under your account. You will promptly notify us at [email protected] if you discover or otherwise suspect any unauthorised use of your login.

2. DESCRIPTION

We will provide accurate description of the products and/or services offered on the Website or the App. However, we are not responsible as to the accuracy, completeness, reliability, suitability or timeless of the information and materials found on the Website or the App. The pictures shown are for illustration purpose only. The materials on the Website or the App are provided for general information only and should not be relied upon or used as the sole basis of making decisions without consulting primary, more accurate, more complete or more timely sources of information.

3. ORDERING      

You may select the following options for your online order: Pick Up or Delivery at the App.

When placing your order for pick up, you will only have to choose one of any available outlets as pick up location and the specified time you select to pick up. In some cases, a reasonable delay may be expected. 

When placing your order for delivery, you will only have to choose current location or delivery address and we will do our utmost best to make delivery on the specified time you select delivered to your home or office.

Order must be received before the specified cut-off time for that given product which will be shown as you proceed through the ordering process. Before placing your order, you shall review your order carefully as we shall not be held responsible for any failure to do so or changes after your order is made to the time, delivery address or items.

     3.1 PLACING ORDER

To complete your order, please follow the onscreen instructions after clicking “Order Now”. At “Order Confirmation”, you are required to review all the information you provide, including the pick up outlet or delivery address, order, payment methods, vouchers and payment details is true, accurate and complete before you click “Proceed Payment”. Order is successfully placed when your order status is “Received”.

     3.2 CANCELLING ORDER

You may cancel your order without charge at any time when your order is in pending payment status. No cancellation is allowed once your order is in “Received” status.

We may notify you that your order has been cancelled or if an item becomes unavailable at any time. You will not be charged for order which cancelled by us. We will reimburse you where payment is made using the same method you used to pay for your order or we may apply credit to your account. The processing of reimbursement may take up to fourteen (14) working days.

4. PRICES AND PAYMENTS    

All prices are in Ringgit Malaysia (MYR) and are inclusive sales and service tax (“SST”). Prices for our products are subject to change without notice. Payment can be made online via credit card, online banking or e-wallet through Razer Merchant Services. Payment may also be made by using Wallet.

For order via Delivery, you hereby agree and authorize us to source for delivery on your behalf and you have the obligation to pay the applicable fees to the third party service provider for the purpose of delivering and to authorize us to pay on your behalf, where applicable.

5. EARNING AND REDEMPTION OF POINTS

If you are registered as a member via the App, you will be entitled of one (1) point for every RM1 spent upon your order is flagged as “Completed”. Upon accumulating the points, you will be entitled to vouchers which you may present on the App for your redemption from time to time. Points have no cash or monetary value and are not redeemable for cash in any form.

We reserve the right to set, alter, revise or revoke any part of the earning and redemption value of the points as we deem fit, without prior notice.

6. APPLYING A VOUCHER CODE

You may apply a voucher to your account by selecting the voucher/entering the voucher code at the point you place an order. Unless otherwise stated, a voucher which has been applied to your account will remain there until it is redeemed or expired in accordance with the term of that voucher.

     6.1 TERMS AND CONDITIONS OF VOUCHER CODE

Vouchers are usually subject to conditions, such as time limits, limits to particular categories of customer or use only at a particular menu item. Using of a voucher in payment or part payment may be subject to specific conditions which applicable to that voucher only. The payment details where you confirm your order for items will show the total order value and the applicable voucher (if any). If there is a voucher credit on your account which does not apply to your order, it will not appear on the payment details. You will have to choose to pay in another way or cancel your order. Only one voucher can be redeemed per order. You only can use once per voucher.

We reserve the right to not honour the voucher code if we believe the terms and conditions have not been met.

7. PICK UP AND DELIVERY

     7.1 PICK UP

You will receive notification to pick up your order once your order is ready. You are required to check and confirm your order upon pick up and before leaving the outlet. Any discrepancy or missing/incomplete order must be notified promptly. We shall not be held accountable for any discrepancy or missing items once you have left the outlet.

In the event unreasonable delays in pick up attributable to you, you bear the risk of any damage or loss of your order or any deterioration in quality or change in condition of your order (e.g. changes in the temperature fit for consumption). In this case, you shall not be entitled to replacement or refund of your order.

     7.2 DELIVERY

We may appoint third party service provider for the purpose of delivering your order within the time slot selected. You are subjected to the terms and conditions laid out by such third party service provider. We shall not be held liable for any delay in delivery.

We will contact you to arrange an alternative delivery time slot if the delivery of your order is likely to be substantially delayed. You may decline to accept your order if that time slot is unacceptable to you. We will refund you the cost of such order or credit the cost of such order to your account. The processing of refund may take up to fourteen (14) working days.

You shall be available at the time of delivery and ensure adequate arrangement is made. All risk in the products shall pass to you upon delivery. In the event where we are unable to reach you, we will attempt to contact you at the phone number given and the driver is unable to find a safe location to leave the drink and if you are still unreachable, the order shall be deemed delivered and you will be liable for its payment in full as if you had received your order.

8. GIFT CARDS

We may allow you to purchase gift cards to your loved one at the App. In connection to purchase a gift card, you will have to (1) choose a gift card theme, (2) select gift card amount, (3) enter phone number of the recipient and (4) enter gift card message. You may choose your payment method and redirect to make payment through Razer Merchant Services.

9. WALLET      

Wallet may allow you to load a monetary value onto your account on the App for future purchases from outlets. Wallet can be used to make any purchases via the App. The monetary value that you load onto your Wallet is a pre-payment only for goods and services of outlets. No interests, dividends or any other earnings on funds loaded onto Wallet will be paid or credited to you by us. The value in Wallet is not insured or guaranteed by any person or entity. Wallet cannot be exchanged for cash.

We reserve the right not to accept any Wallet or limit the use of Wallet if we reasonably believe that is unlawful, unauthorised or fraudulent. The value associated with Wallet is not insured or guaranteed by any person or entity.

     9.1 LOADING VALUE ONTO WALLET

You can load value onto your Wallet via the App by using credit card, online banking or e-wallet through Razer Merchant Services. You will be agreeing where you provide your personal data to us in order to be held pursuant to our Privacy Policy on servers in Malaysia and proceed with topping up facility. The minimum amount that can be loaded onto Wallet is RM10 and the maximum amount of RM1000 is permitted. You may select the amount which can be reloaded or enter specific amount. 

     9.2 EXPIRE DATE AND NON-REFUND

Your Wallet will expire if there is no usage, dormant or inactive in one (1) year from the last transaction date. Subsequently, your Wallet shall be deemed expired and will automatically deactivate. Any remaining balance in Wallet will be forfeited and is non-refundable upon deactivation under any circumstances.

     9.3 COMPLAINT HANDLING

We reserve the right to correct the amount in Wallet of your account if we believe that is clerical, billing or accounting error. Please contact us at [email protected] if you have questions about your transaction history or any correction against your Wallet. We will conduct an investigation and correct any error that we verified. However, if no error was found, we will give an explanation. We shall have no liability for any billing error.

10. ALLERGENS

You acknowledge and agree that we do not warrant, represent or guarantee nor assume responsibilities and any risks related to the proper handling, preparation, storage, use and consumption of the products you receive from us and that our products are suitable for people with allergies.

11. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not warrant, guarantee or represent that using of the Website or the App will be timely, secure, uninterrupted and error free. You hereby agree that your use of or inability to use the Website or the App is at your sole risk. We provide the products or the services to you “as is” and “as available” for your use, without any representations, warranties or conditions, either express or implied. You acknowledge and consent that we shall not be held liable in directly or indirectly for any damage or loss in any way related to your use, inability to use, or reliance the information and materials, or any non-performance or unavailability or any third party links, or the conducts of the other users in violation of these Terms and Conditions through the Website or the App, or any act, omission or error which caused by any computer hacking incident or other cybercrimes affecting the Website or the App. These limitations of liability will survive the termination of these Terms and Conditions and your use of the Website or the App. If you are dissatisfied with the Website or the App, your sole remedy is to discontinue using the Website or the App.

To the fullest extent permitted by applicable law, you release Ang Ang Roastery (HQ) Sdn. Bhd. (“we”, “ours”, “us”) from responsibility, liability, claims, demands, and damages (actual and consequential), or any one of the foregoing, of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between users and the acts or omissions of third parties. You expressly waive any rights you may have under the Malaysian Law as well as any other statute or common law principles that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favour at the time of agreeing to this release.

12. SEVERABILITY

If any provision of these Terms and Conditions shall be deemed unlawful, void or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

13. TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement. These Terms and Conditions are effective and valid unless and until terminated by either you or us.

You acknowledge and agree that we have the right to suspend and terminate your account or use of the Website or the App for any reason without notice where we believe you have violated any provision of these Terms and Conditions. You agree we shall not be held liable to you as a result of any suspension or termination. We reserve the right to modify and/or discontinue the Website or the App at any time for any reason and without notice.

14. APPLICABLE LAW AND JURISDICTION

To the fullest extend permitted by applicable law, these Terms and Conditions shall be governed by the laws of Malaysia, without regard to its conflicts of law rules and all claims, legal proceedings or litigation arising in connection with these Terms and Conditions and you will be brought solely in the courts of Malaysia.

15. PERSONAL DATA PROTECTION ACT (“PDPA”) 2010

You agree and consent to us for collecting, processing, using and disclosing your personal data pursuant to these Terms and Conditions as further described in our Privacy Policy. Our Privacy Policy shall form part of these Terms and Conditions.

16. INTELLECTUAL PROPERTY

The Website and the App including all information, software, code, text, displays, images, photographs, video, sound, figures, menus, web page, hyperlinks, colours, schemes, tools, fonts, designs, diagrams, layouts, methods, processes, trademark, trade name, logos and other materials and contents that are part of the Website and the App (“Materials”) are the exclusive property to us or otherwise licensed to us. The Materials are protected under copyright, trademark law, and/or any other applicable rules and regulations. You are granted a limited, non-exclusive, non-sublicensable, non-transferrable, revocable license to access and use the Website and the APP, download and print hard copy portions of the Materials for your informational, non-commercial and private use only, and not for resale, republication, assignment, sublicense, distribution, preparation of derivative works or other use. We do not permit third parties to use the Materials in any manner, including advertising, as an endorsement for any products or services in association with contests or promotions, or for any other purpose without our prior written consent.
